Terms of Use

Please read these Terms of Use (“Terms”) carefully before accessing or using AttentionLeak (“Service”). By accessing or using the Service in any manner, you agree to be bound by these Terms. If you do not agree to all of the Terms, you may not access or use the Service.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you (“User”) and the operator of AttentionLeak (“we,” “us,” or “Service”). Your continued use of the Service following any modification to these Terms constitutes acceptance of those modifications. We reserve the right to update these Terms at any time without prior notice. The most current version will always be available at this URL.

2. Description of Service

AttentionLeak is an automated analytical tool that computes a numerical “attention score” for publicly available YouTube videos. The score is derived from statistical signals — including cut rate, motion intensity, audio energy, silence ratio, and rhythm alignment — processed by machine-learning models. The Service is provided solely for informational and educational purposes.

3. User Authorization & Agency

By submitting a YouTube URL or video identifier to the Service, you explicitly authorize AttentionLeak to act as your limited agent solely for the purpose of fetching publicly available video metadata and audio-visual signal data associated with that URL, and computing an attention score on your behalf. This authorization is limited in scope to the specific URL submitted and does not grant AttentionLeak any broader rights over your account, content, or credentials.

You represent and warrant that: (a) you have the legal right to request analysis of the submitted content; (b) the submitted URL points to publicly accessible content; and (c) your use of the Service does not violate the YouTube Terms of Service or any applicable law or regulation.

4. Acceptable Use

You agree not to:

  • Use the Service to analyze private, unlisted, or access-restricted content without the rights-holder’s explicit permission.
  • Reverse-engineer, scrape, or systematically extract data from the Service by automated means without our prior written consent.
  • Submit malformed, malicious, or deceptive URLs with the intent to exploit system vulnerabilities.
  • Resell, redistribute, or sublicense the Service or its output data without express written authorization.
  • Attempt to circumvent rate limits, credit quotas, or authentication mechanisms.
  • Use the Service in any manner that violates applicable local, national, or international law.

5. Credits and Payments

Certain features of the Service require the purchase of credits. Credits are non-refundable except in the event of a documented technical failure on our part that prevents delivery of the requested analysis. Credits have no cash value, are non-transferable, and expire upon account termination. We reserve the right to modify credit pricing at any time with reasonable notice.

6. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that:

  • Attention scores are accurate, complete, or suitable for any particular purpose;
  • The Service will be uninterrupted, error-free, or free from harmful components;
  • Results obtained from the Service will meet your expectations or requirements;
  • Any defects or errors will be corrected.

Attention scores are probabilistic outputs of machine-learning models trained on limited datasets. They represent a statistical estimate only and should not be treated as definitive measurements of video quality, audience engagement, or platform performance. Individual results may vary significantly based on content type, genre, and audience demographics.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall AttentionLeak, its operator, affiliates, licensors, service providers, employees, agents, officers, or directors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:

  • Loss of profits, revenue, subscribers, or business opportunities;
  • Decisions made by you or third parties in reliance on any attention score or analytical output provided by the Service;
  • Any action or inaction taken by YouTube or any other platform in connection with your account as a result of content you submitted for analysis;
  • Unauthorized access to or alteration of your data.

Our total cumulative liability to you for all claims arising out of or related to the Service shall not exceed the greater of (a) the total amount you paid to AttentionLeak in the twelve (12) months immediately preceding the claim, or (b) USD $10.00.

8. Intellectual Property

All software, algorithms, user interface designs, and scoring methodologies comprising the Service are the exclusive property of AttentionLeak and are protected by applicable intellectual property law. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes only.

Video content, titles, creator names, and thumbnails remain the property of their respective rights-holders. AttentionLeak claims no ownership over third-party content accessed via the YouTube Data API.

9. Third-Party Services

The Service integrates with third-party platforms including YouTube, PayU, and AWS. Your use of those platforms is subject to their respective terms of service and privacy policies. We are not responsible for the practices, content, or availability of any third-party service.

10. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination for cause, your right to use the Service ceases immediately and any unused credits are forfeited.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operator is domiciled, without regard to its conflict-of-law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AttentionLeak with respect to your use of the Service and supersede all prior agreements, representations, and understandings.
